Contact Info:

The client must provide “Sarah Marshall Photography” with their full name, contact number, billing address and email address.
This information will be kept private and only used for the completion of the job, payment, and distribution of images.
Future contact may also occur regarding photoshoots or products that may interest you.

Booking fees & payments:

A 50% retainer is due to save the date and is non-refundable unless the photographer needs to cancel due to unforeseen circumstances. Except for weddings which is a $800 retainer.
The package fee must be paid in full before the client receives their digital files, USB flash drive and/or prints.
Fees must be paid via internet banking by the due date.
Failure to pay may mean the photoshoot cannot go ahead or images may not be available to view.
Bank account details will be provided on the invoice.

Copyright:

The copyright of photographs remains with the Photographer “Sarah Marshall Photography”.
The Photographer grants the Clients permission to make copies of the images under the following conditions:
The images taken by the Photographer are for your personal use or commercial marketing online and in print and photographs are not allowed to be on-sold or altered without prior written permission from the Photographer.

“Sarah Marshall Photography” appreciates the use of some of the best images to be used on her website, social media and print materials for future marketing. Please advise if this is an issue.

Model release:

The Clients grant the Photographer “Sarah Marshall Photography”, the irrevocable and unlimited consent to use the photographs of the Clients for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images.

The Clients hereby release the Photographer from all liability and claims in connection with the images.

The client agrees to get signed consent forms from parents of any children featuring in photographs at a commercial event.

Expenses & travel:

 Client agrees to reimburse the Photographer for all reasonable expenses incurred in creating the Images, provided that such expenses shall be itemized and supported by invoices. The client is responsible for all Out-of-Pocket Expenses such as parking, entry, toll and other expenses directly related to the photographic assignment. Such expenses will be billed as it becomes available.
Travel: $1.00 per kilometre will be charged when traveling more than 50 km outside of Whangarei.

Final photo product:
The Photographer makes no guarantee, either expressed or implied, in regard to the quality of the Images, because they are subjective and in addition, may be influenced by many factors beyond the control of the Photographer, especially during outdoor photoshoots with fluctuating light conditions and with live events with low and inconsistent light.

It is also understood that the Client is hiring the Photographer for her technical and artistic expertise and, therefore, the Photographer reserves the right to edit the Images as she sees fit. The Client is expected to have viewed the photographer’s previous work and therefore should expect to receive images of the same style and structure.

Where photographic works are not of an acceptable technical quality, making it unfit for the purpose of its specified use, then no fee or job-related costs are due to the Photographer.
The Photographer has the right to rectify the defect causing the rejection within a reasonable time, having regard to the urgency of the work. If rectified the Photographer is entitled to their fee and job-related costs but may not charge the client an extra fee or cost for rectifying the defect.

If the Photographer produces photographic works that are in the same style and structure as the Photographer’s past works (by reference to the Photographer’s portfolio), the client is deemed to have accepted the Photographer’s artistic interpretation.

The client acknowledges that images may appear different on computer screens and prints could be different depending on the photographic lab where they choose to print their images.
Colours may also fade over time, and this is out of the photographer’s control.

The client is responsible for backing up their images. “Sarah Marshall Photography” Will keep 1-3 copies of all the images for as long as possible but is not liable for the loss of any of the client’s images once the job is completed.

Overshooting:

This occurs for many reasons and therefore the client will never receive a copy of every shot.
The final images given are chosen by the photographer.
The number of images chosen is agreed upon when the photography package is chosen.

Cancellation or postponement of booking:

The client must contact “Sarah Marshall Photography” as soon as possible if there needs to a postponement or cancellation of the photoshoot. Where the Client cancels or postpones a booked appointment, the Client must pay, at the Photographer’s discretion, the amounts that have already been invoiced or are due as outlined on the Booking agreement, regardless of whether the appointment is attended or not.

Where a booked appointment involves more than one person, it is the Client’s responsibility to ensure that everyone required arrives at the appointment on time. Failure of any person to arrive at the appointment on time will result in, at the Photographer’s discretion,
cancellation or postponement.

The Booking appointment and any fees paid prior to cancellation or postponement of the appointment are transferable to another person as if it were the original person, as long as the Booking is the same and the date and time of the appointment are not changed.
